Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by DigiMoksha Technologies Pvt Ltd (“SkillMoksha”, “we”, “us”, or “our”), including skillmoksha.ai and app.skillmoksha.ai (the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use.
2. The Services
SkillMoksha provides an AI-assisted hiring and talent-assessment platform and related tools. We may add, modify, or discontinue features at any time. AI-generated outputs (such as scores, summaries, or recommendations) are provided to assist human decision-making and may contain errors; you are responsible for reviewing outputs and for your final hiring decisions.
3. Acceptable use
You agree not to:
- Use the Services unlawfully or in violation of these Terms or applicable anti-discrimination, employment, or data-protection laws;
- Upload content you do not have the right to share, or that infringes others’ rights;
- Reverse engineer, scrape, or attempt to access the Services or their source code without authorisation;
- Interfere with, overload, or disrupt the Services or their security;
- Use the Services to build a competing product, or resell them without our written consent.
4. Customer content & data
You retain ownership of the content and data you submit (“Customer Content”). You grant us a limited, worldwide licence to host, process, and use Customer Content solely to provide and improve the Services and as permitted by our Privacy Policy. You represent that you have all necessary rights and consents (including from candidates) to submit Customer Content.
5. Fees & payment
Paid features are billed as set out in your order form or plan. Unless stated otherwise, fees are exclusive of taxes, are non-refundable except as required by law, and unpaid amounts may result in suspension. We may change pricing prospectively with reasonable notice.
6. Intellectual property
The Services, including all software, models, designs, and trademarks, are owned by SkillMoksha or its licensors and are protected by law. Except for the rights expressly granted to you, no rights are transferred. Feedback you provide may be used by us without restriction.
7. Third-party services
The Services may integrate with third-party tools (e.g., Calendly, analytics, and advertising providers). We are not responsible for third-party services, and your use of them is governed by their own terms.
8. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI outputs. We do not warrant that the Services will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, SkillMoksha and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim, or, if you have paid nothing, one hundred (100) Indian Rupees (INR 100).
10. Indemnity
You agree to indemnify and hold harmless SkillMoksha from any claims, damages, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Services, or your breach of these Terms.
11. Suspension & termination
We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or fail to pay. You may stop using the Services at any time. Provisions that by their nature should survive termination (e.g., sections 4–10, 12) will survive.
12. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts of Noida, Uttar Pradesh will have exclusive jurisdiction over any disputes, except that either party may seek injunctive relief where appropriate.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated effective date. Your continued use of the Services after changes take effect constitutes acceptance.
